Digital Products Terms of Use & Disclaimer

These Digital Products Terms of Use & Disclaimer (“Terms”) apply to digital products sold or provided by My Texas Tax & Advisory (“MTTA”), including spreadsheets, calculators, templates, worksheets, guides, downloads, digital files, and other digital resources (“Digital Products”).

By purchasing, downloading, accessing, or using an MTTA Digital Product, you acknowledge that you have read, understood, and agree to these Terms.

1. Educational and Informational Purposes

MTTA Digital Products are designed to provide educational, informational, organizational, planning, and business-support resources. Some Digital Products may include calculators, formulas, estimates, projections, examples, financial metrics, or other tools intended to help users better understand and evaluate their business or financial information. Results depend upon the information entered by the user and the assumptions and calculations contained within the applicable product. Actual results may differ.

2. Not Professional Advice

MTTA Digital Products do not constitute individualized accounting, tax, legal, investment, financial planning, or other professional advice. The purchase or use of a Digital Product does not create a professional-client, advisory, fiduciary, or similar relationship between you and My Texas Tax & Advisory. You should consult an appropriately qualified professional regarding decisions specific to your business, finances, taxes, legal obligations, or individual circumstances.

3. User Responsibility

You are responsible for the accuracy and completeness of information you enter into or use with a Digital Product. You are also responsible for reviewing the results, calculations, recommendations, examples, or other information produced or provided by the product and determining whether they are appropriate for your circumstances before relying upon them. Business, financial, pricing, budgeting, hiring, borrowing, purchasing, tax, or other decisions remain solely your responsibility.

4. No Guarantee of Results

My Texas Tax & Advisory does not guarantee any particular result from the purchase or use of a Digital Product. This includes, without limitation, any guarantee regarding profitability, revenue, savings, pricing, cash flow, tax results, business performance, financial outcomes, or other results. Digital Products are tools intended to assist with planning, organization, education, or decision-making and do not guarantee a particular outcome.

5. License and Permitted Use

Unless otherwise stated with a specific product, your purchase provides a limited, non-exclusive, non-transferable license for use by one purchaser for personal use or for one business. You may make reasonable backup or working copies for your own permitted use. Such access does not provide that person or organization with a separate license to use the Digital Product for themselves, another client, or another business.

You may not:

Resell, redistribute, sublicense, publish, share, transfer, or give a Digital Product to another person or business except as specifically permitted above.
Upload or distribute a Digital Product through a public website, shared drive, file-sharing service, template marketplace, membership library, resource library, or similar service where unauthorized persons may access it.
Remove or alter copyright, ownership, branding, licensing, or proprietary notices.
Copy, reproduce, modify, or create derivative versions of a Digital Product for commercial resale or distribution.
Reverse engineer, extract, reproduce, copy, or commercially distribute protected formulas, calculations, worksheets, templates, designs, or other proprietary components.
Use one purchased license to provide copies of the Digital Product to multiple unrelated businesses, clients, or users.

A separate license is required for another business or unrelated user unless the applicable product expressly provides otherwise.

6. Intellectual Property

MTTA Digital Products, including their design, formulas, calculations, templates, instructions, written content, graphics, layouts, worksheets, methodologies, and related materials, are owned by My Texas Tax & Advisory or used with permission, except where otherwise stated. Purchasing a Digital Product provides a license to use that product in accordance with these Terms. It does not transfer ownership of the Digital Product or any intellectual property rights.

7. Software Compatibility, Access and Modification

Digital Products are designed for the software, platform, file format, or application identified in the applicable product description or instructions. Functionality, appearance, formulas, links, formatting, automation, data validation, protections, or other features may differ when a Digital Product is opened, converted, imported, exported, edited, or used with another application or software version. My Texas Tax & Advisory is not responsible for errors, broken formulas, altered calculations, removed protections, formatting changes, lost functionality, or other problems resulting from user modifications, software updates, file conversion, or use on an unsupported platform. Where both Microsoft Excel and Google Sheets versions are provided, each version should be used in its intended platform. Converting between formats may change functionality or protections.

8. Product-Specific Instructions and Disclaimers

Certain Digital Products may contain additional instructions, assumptions, limitations, disclaimers, license terms, or usage requirements specific to that product.

Those product-specific provisions are incorporated into these Terms and apply in addition to these general Terms. If a product-specific provision conflicts with these Terms, the product-specific provision will control with respect to that Digital Product.

9. Limitation of Liability

To the fullest extent permitted by applicable law, My Texas Tax & Advisory will not be liable for indirect, incidental, consequential, special, exemplary, or similar damages arising from or related to the purchase, use, misuse, inability to use, or reliance upon a Digital Product. You assume responsibility for decisions made using information, calculations, estimates, templates, or other materials contained in or produced by a Digital Product. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

10. Updates and Changes

Digital Products, including their features, formulas, calculations, content, documentation, and these Terms, may be revised or updated from time to time. Purchase of a particular product or version does not guarantee access to future versions, upgrades, revisions, additional features, or other products unless specifically stated at the time of purchase.

11. Refunds

Due to the digital nature of MTTA Digital Products and the immediate access to or delivery of digital content following purchase, all sales of Digital Products are final. No refunds, returns, exchanges, or credits will be provided after purchase. Please review the product description, compatibility requirements, features, and other product information carefully before completing your purchase to ensure the Digital Product is appropriate for your needs.

12. Third-Party Platforms and Services

Some Digital Products may be delivered, accessed, stored, or used through third-party platforms or software, including Microsoft Excel, Google Sheets, or other services. My Texas Tax & Advisory does not control third-party platforms and is not responsible for their availability, functionality, security, pricing, policies, updates, or changes. References to third-party products or services do not imply sponsorship or endorsement unless expressly stated.

13. Agreement

By purchasing, downloading, accessing, or using an MTTA Digital Product, you acknowledge that you have read, understood, and agree to these Digital Products Terms of Use & Disclaimer, together with any product-specific terms or disclaimers applicable to the Digital Product you purchase or use.
